What is the Residential Tenancies Act?

Most tenancy agreements in states such as NSW, are covered by the Residential Tenancies Act. This act sets out the obligations and rights of both landlords and tenants, guiding their interactions and relationship with one another. The act also gives power to residential tenancy tribunals such as the NSW Civil and Administrative Tribunal (NCAT) to hear and settle disputes pertaining to tenancy agreements.

Are residential tenancy tribunals legally binding?

While tribunals are not a formal court, they are typically legally binding. This means that both landlords and tenants are required to comply with the rulings issued by the tribunal. If either party is not satisfied with the outcome of the ruling, they typically have the right to appeal within 28 days.
